
In March 2021, the New Mexico legislature passed Senate Bill 32 entitled the “Wildlife Conservation and Public Safety Act” which prohibits the use of foothold and body grip traps as well as snares on all of the state’s more than 22 million acres of state and federally controlled public land. The bill was primarily written by the New Mexico Animal Protection Voters who served as the sole subject matter experts in all legislative hearings without any consultation or testimony from the New Mexico Department of Game & Fish. Proponents of the SB 32 (also known as Roxy’s Law) were provided a disproportionate amount of time to testify on behalf of the bill whereas opponents were greatly limited in the number of testimonies provided and the amount of time to provide such testimony. In several cases, opponents of the bill were muted by committee chairs while providing respectful testimony in the allotted time. Despite the overwhelming bias of the legislature to see this bill enacted, the bill narrowly passed the House 35-34 and was signed into law immediately by the governor. Senate Bill 32 went into effect on April 1, 2022.
In response to the bias of the legislature during committee hearings and several potential unconstitutional exemptions provided in the law, the New Mexico Trappers Association, the Fur Takers of America, and the National Trappers Association have pursued legal actions challenging Senate Bill 32 with the goal of restoring public land trapping in New Mexico. Public land trapping is critical to the management of furbearer and predator populations across the state which is largely publicly owned. At no cost to the public, recreational trappers regulate wildlife populations which enhances game species populations as well as reducing human-wildlife conflicts, wildlife diseases, and livestock depredation.
Because of the high expected costs of successfully fighting this legal challenge, the parties of the suit formed an alliance known as the United Sportsmen for Wildlife Conservation (US4WC) to raise funds to help with all legal costs associated with the fight.
